Glacier Beverage Terms & Conditions

TERMS & CONDITIONS: To ensure clarity and a positive customer experience, by using this website and by placing your order, constitutes that you have read, understand, and agree in full with the following Terms & Conditions.

We reserve all rights, including the right to update, change or replace any part of these TERMS & CONDITIONS as needed or necessary by notifying you and/or by CHANGES MADE to our website (or any  form / application), including our ESTIMATE and/or INVOICE documents. It is your sole responsibility to check periodically for changes. Your continued business following an update(s) or posting of any changes constitutes full and complete acceptance of those changes.

> DELIVERY: Due to elements outside of our control (parts and equipment, national freight partners, weather, etc.), Glacier Beverage does not offer a guarantee on specific “in-hands” dates. We will do everything possible to meet your requested delivery date and specific delivery instructions.
> NEW ORDERS: An initial payment of $99 (or up to 50%) is due upon approving this quote and to begin the creative process (artwork / designing your label). Once final label artwork has been approved (by you), the remaining balance will be due (prepaid in full) before production will commence. (Note: This is when the standard lead time begins)
> PAYMENT: All orders are CUSTOM (made-to-order for you) and therefore non-refundable once artwork has been approved (by customer) and production has commenced; pre-payment is required and all sales are final. The Customer will not, under any circumstances, issue or threaten to issue any chargebacks to Glacier Beverage or to the Customer ‘s credit card and/or form of payment (ie, Stripe, PayPal) for any reason whatsoever related to their purchase. If you have any issue with your delivered product, please contact Customer Service ([email protected]) within 72-hours of delivery to discuss. We will not accept product returns or offer refunds — as this is a custom made product — all sales are final. We accept the following credit cards: Visa, Master Card, Discover, and AMEX*. You can also submit payment with a company check** or bank transfer (wire). Returned checks (NSF) will incur a $48 fee. *Note: Payments with Credit/Debit Card over $499 will incur CC Convenience Transaction Fee (@ 3.45 – 4.25%).
> PRODUCTION: In most cases, the quantity of water (and/or labels, or other products) that you originally ordered will be the exact quantity produced and delivered. On occasion, orders will be subject to the industry’s standard 15% overrun or underrun. This means that the actual quantity of full cases produced and shipped may be 15% more or less than the original quantity ordered and will be billed/credited accordingly. Due to normal wear and tear of bottle molds and fabrication equipment (warn out, replaced, or retired), the specific bottle “design or style” you receive may vary from a picture / sample you received or ordered previously. Upon termination, if Glacier Beverage has ordered, produced, stocked, or inventoried raw materials needed for Client’s custom orders (caps, label inventory, boxes/trays, stickers, other, etc.) or has produced any floored (finished) product(s), Client agrees to purchase and receive delivery of all “finished product” and/or buyout any unused raw materials (to be destroyed), pricing subject to standard market rates setforth by Glacier Beverage.
> RESOLUTION & SEVERABILITY: Please be advised that if your account is in default, or a judgement is obtained against you as a result of such lawsuit, the judgement may include all court costs, prejudgment interest, collection fees, and attorney’s fees, in addition to the principal amount currently owed. If any of these TERMS & CONDITIONS shall be deemed invalid, void or for any reason unenforceable, that term or condition shall be deemed severable and shall not affect the validity and enforceability of any remaining term or condition.
> CHOICE OF LAW AND VENUE: In the case of a dispute, these Terms and Conditions are governed by the laws of the United States of America and the laws of the state of Arizona, where Glacier Beverage is headquartered. Any action brought by any party hereto shall be brought within the Choice of Venue in the State of Arizona, County of Pima (or County of Maricopa), and you consent to exclusive jurisdiction and Venue in such courts.
